RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT AND IMAGE RELEASE
IN CONSIDERATION of being permitted to compete, officiate, observe, work for, volunteer, or participate in any way in the activities and events at the Pickles and Paws event or for being permitted to enter for any purpose any RESTRICTED AREA (defined as any area requiring special authorization, credentials, or permission to enter or any area to which admission by the general public is restricted or prohibited), EACH OF THE UNDERSIGNED, for himself, his personal representatives, heirs, and next of kin understand the following:
I understand that all fees paid are non-refundable and deemed earned upon my completed registration
I recognize that participation in this event may be considered a hazardous activity; which is inherently dangerous.
I have voluntarily entered the event despite all known and unknown risks of serious personal injury and/or death presented by preparing for and participating in this event.
I will not participate unless I am physically, medically, and mentally able to do so.
I know my own capabilities and limitations regarding participation in this event.
I will not consume any alcohol and/or drugs prior to running the 5K fun run portion of the event.
I am at least 18 years of age or my parent or guardian has consented to my participation in this event.
I understand that all ticket purchases/registrations and entries are final and that refunds will not be granted for any reason.
I agree that in the event of an emergency Wonderland Tails Rescue Inc. and its affiliated companies may cancel or reschedule this event date and/or venue location and under such circumstances, no refunds will be granted.
I grant permission to Wonderland Tails Rescue Inc., it's affiliates, sponsors, and assigns to use any photographs, motion pictures, recordings or any other record of this event for any purpose including, but not limited to: promoting, advertising, and/or marketing purposes. Any and all photographs, motion pictures, recordings, or other records of the event are the sole property of Wonderland Tails Rescue Inc. No royalty fee or other compensation may be payable to the registrant or guardian by reason of such release.
Now, therefore, in consideration of being permitted to compete, officiate, observe, work for, volunteer, or participate in the scheduled event, I expressly and freely agree as follows:
To assume all risk of serious personal injury or death arising from participating in or preparing for this event.
To waive any and all claims that I may have in the future against Wonderland Tails Rescue Inc., their officers, licensors, agents, employees, volunteers, directors, shareholders, promoters, affiliated entities, subsidiaries, all insurers, and all sponsors, for any and all loss, damage, injury, or expense that I may suffer, or that my next of kin may suffer, as a result of participating in this event, due to any cause whatsoever, including, but not limited to; negligence on the part of Wonderland Tails Rescue Inc., their officers, licensors, agents, employees, volunteers, directors, shareholders, affiliated entities, subsidiaries, all insurers, and all sponsors.
I acknowledge and understand that participation in puppy yoga activities involves physical movements and poses that may carry inherent risks, including but not limited to the risk of injury due to the presence of puppies. I voluntarily assume all risks associated with participating in these puppy yoga sessions, including but not limited to injuries that may occur as a result of my participation in puppy yoga activities led by Happy and Free Yoga. I agree to waive any claims against Wonderland Tails Rescue Inc., Happy and Free Yoga, and their respective affiliates, sponsors, and personnel for any injuries or damages that may arise from my participation in these puppy yoga activities.

To release from liability and hold harmless Wonderland Tails Rescue Inc., their officers, licensors, agents, employees, volunteers, directors, shareholders, promoters, affiliated entities, subsidiaries, all insurers, and all sponsors for any and all loss, damage, injury, or expense that I may suffer, or that my next of kin may suffer, as a result of participating in this event, due to any cause whatsoever, including, but not limited to; negligence on the part of, Wonderland Tails Rescue Inc., their officers, licensors, agents, employees, volunteers, directors, shareholders, affiliated entities, subsidiaries, all insurers, and all sponsors.
I agree that any claim which I may at any time bring for any reason associated with this event shall be submitted to the State or Federal Courts in the State of New York and no other jurisdiction. Any claim brought shall be governed by the laws of the state in which the claim arose.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
